These Terms of Use govern your access to and use of areyoubeeping.org (the “Site”), operated by Hyak Consulting, LLC (“Hyak Consulting,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About this Site
This Site provides information about DTS products, including the DTS Transceiver Checker, Solar Power System, and custom signage. The Site is informational and used to respond to inquiries. We do not sell products or process payments through this Site. Purchases, if any, are arranged separately by direct agreement.
2. Safety Notice
Our products are aids to avalanche safety practice. They are not substitutes for training, judgment, or appropriate equipment, and they cannot make backcountry travel safe.
A transceiver checker verifies that a transmitting avalanche transceiver is detected at the moment it passes the device. It does not verify that a transceiver is functioning correctly in all respects, that its batteries will last, that it is properly worn, that its user knows how to perform a search, or that any person is prepared for avalanche terrain. A successful check is not a certification of readiness.
Avalanche terrain is inherently hazardous. Nothing on this Site should be relied on as avalanche safety instruction or as a basis for decisions about entering avalanche terrain. Seek qualified avalanche education, consult current forecasts from your regional avalanche center, and carry and know how to use appropriate rescue equipment.
3. Accuracy of Information
We work to keep product specifications, descriptions, and documentation on the Site accurate and current, but we do not warrant that they are complete, accurate, or up to date. Specifications may change as products are revised. Information on the Site does not constitute a specification, warranty, or performance guarantee for any product you may acquire; the terms of any purchase are governed by the agreement covering that purchase.
4. Permitted Use
You may view, download, and print material from the Site for your own informational and non-commercial use, provided you keep all copyright and other proprietary notices intact.
You agree not to:
- Use the Site in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems
- Interfere with or disrupt the Site, including by introducing malware or by automated scraping that burdens our infrastructure
- Use the Site’s contact or quote forms to send unsolicited commercial messages
- Reproduce, republish, or redistribute Site content for commercial purposes without our prior written permission
- Remove, obscure, or alter any proprietary notice, or misrepresent your affiliation with us

The Site and its contents — including text, product documentation, images, graphics, logos, and the selection and arrangement of that material — are owned by Hyak Consulting, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. “DTS,” “AreYouBeeping,” and associated marks and logos are marks of Hyak Consulting, LLC. Product names and marks of other companies referenced on the Site are the property of their respective owners, and their use does not imply endorsement or affiliation.
6. Inquiries and Submissions
When you contact us through the Site — including via the quote request and support request forms — you agree to provide accurate information. Our handling of information you submit is described in our Privacy Policy.
Submitting an inquiry does not create a confidential relationship or any obligation on our part. Please do not send confidential, proprietary, or sensitive information through the Site. Any suggestions, feedback, or ideas you send us about our products may be used by us without restriction, obligation, or compensation to you.
7. Third-Party Links
The Site may link to third-party websites, including avalanche centers, educational organizations, documentation, and manufacturers of related equipment. Those sites are not under our control. We provide links for convenience and do not endorse and are not responsible for their content, accuracy, or practices. Your use of a third-party site is governed by that site’s own terms and privacy policy.
8. Disclaimer of Warranties
THE SITE AND ITS CONTENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HYAK CONSULTING, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE OR COMPLETE.
This section concerns the Site. It does not limit any written warranty that may accompany a product you purchase.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HYAK CONSULTING, LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Hyak Consulting, LLC and its members, officers, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of the rights of any third party.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, U.S.A., without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts.
If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and us regarding your use of the Site.
